Welcome to Next Generation Gaming ("NGG", "we", "us", "our"). These Terms & Conditions ("Terms") govern your access to and use of the Next Generation Gaming website, applications, newsletters, community forums, and any related services (collectively, the "Site"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Use of the Site

You may use the Site to read, share, and discuss video gaming news, reviews, guides, trailers, and community content for PlayStation, Xbox, Nintendo, Steam, and PC platforms. You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Site.

2. Eligibility & User Accounts

You must be at least 13 years of age to create an account. If you are under the age of majority in your jurisdiction, you may only use the Site with the involvement of a parent or guardian. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. 3. Submitted Materials

Any comments, feedback, suggestions, ideas, screenshots, videos, artwork, reviews, fan content, or other materials you submit or post to the Site or send to Next Generation Gaming (collectively, "Submitted Materials") shall be deemed non-confidential and non-proprietary. By submitting or posting any Submitted Materials, you grant Next Generation Gaming a non-exclusive, royalty-free, perpetual, irrevocable, worldwide, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such Submitted Materials in any media now known or later developed, including in connection with promotion of the Site, without compensation to you.

You represent and warrant that you own or otherwise control all rights to the Submitted Materials you post, that the Submitted Materials are accurate, and that use of the Submitted Materials by Next Generation Gaming will not violate these Terms, infringe any third-party right, or cause injury to any person or entity.

4. Rules of Conduct

You agree that you will NOT use the Site to:

• Post, upload, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, or racially or ethnically objectionable.
• Impersonate any person or entity, including a Next Generation Gaming employee, or falsely state or misrepresent your affiliation with any person or entity.
• Post or transmit content you do not have the right to make available (including insider information, proprietary content, or content covered by non-disclosure agreements).
• Post or transmit content that infringes any patent, trademark, trade secret, copyright, right of publicity, or other proprietary right of any party.
• Upload, post, or transmit unsolicited advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.
• Upload, post, or transmit material that contains software viruses, worms, Trojan horses, or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software, hardware, or telecommunications equipment.
• Interfere with or disrupt the Site, servers, or networks connected to the Site, or disobey any requirements, procedures, policies, or regulations of networks connected to the Site.
• Harvest or otherwise collect information about others, including email addresses, without their consent.
• Engage in any automated use of the Site, including scraping, data mining, or using bots to submit content or requests, without our prior written permission.
• Violate any applicable local, state, national, or international law.

Next Generation Gaming reserves the right, but has no obligation, to monitor the Site and remove any content, terminate accounts, or take any other action it deems necessary in its sole discretion to enforce these Terms.

5. Public Forums

The Site may include comment sections, discussion threads, community reactions, reviews, and other interactive areas (collectively, "Public Forums") that allow users to communicate with one another. Any content you post in a Public Forum is considered public and non-confidential. Next Generation Gaming does not endorse, support, verify, or agree with the opinions expressed by users in Public Forums. Any reliance on such content is at your own risk.

We reserve the right (but not the obligation) to review, edit, or remove any content posted in Public Forums, or to disclose such content if required to do so by law or in good-faith belief that such action is necessary to comply with legal process, enforce these Terms, or protect the rights, property, or safety of Next Generation Gaming, its users, or the public.

6. Syndicated Content & Attribution

Next Generation Gaming aggregates news headlines and short excerpts from third-party gaming publishers under a fair-use editorial-summary model. Every syndicated item is clearly attributed to its original publisher and links back to the source. Full article text, images, and video remain the property of the original publisher.

If you are a rights holder and believe your content has been used improperly, please submit a request via our DMCA / Copyright Takedown page. We respond promptly to properly submitted notices in accordance with the Digital Millennium Copyright Act.

7. Intellectual Property

All original site design, code, editorial writing, illustrations, logos, and the "Next Generation Gaming" name and mark are the property of Next Generation Gaming and its licensors and are protected by copyright, trademark, and other intellectual property laws. Platform names (PlayStation, Xbox, Nintendo, Steam, PC) and all related game titles, characters, and marks belong to their respective owners and are used here for editorial and identification purposes only.

No material from the Site may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way for commercial use without our prior written permission, except that you may download one copy of the materials on any single device for your personal, non-commercial home use, provided you keep intact all copyright and other proprietary notices.

8. Third-Party Sites & Links

The Site may contain links to third-party websites, publishers, video platforms, storefronts, and services (including YouTube, Steam, official platform holders, news outlets, and social networks). These links are provided solely as a convenience. Next Generation Gaming has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party website. You acknowledge and agree that Next Generation Gaming shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods, or services available on or through any such website. We strongly advise you to read the terms and privacy policy of any third-party site you visit.

9. Linking to the Site

You may link to our home page or article pages, provided you do so in a way that is fair and legal and does not damage or take advantage of our reputation. You must not establish a link in such a way as to suggest any form of association, approval, or endorsement on our part where none exists. You must not frame any part of the Site, place pop-ups over its pages, or otherwise alter its visual presentation. We reserve the right to withdraw linking permission at any time and without notice.

10. Promotions, Contests & Giveaways

From time to time, Next Generation Gaming may host contests, sweepstakes, giveaways, or other promotions (each, a "Promotion"). Each Promotion may have its own additional rules, eligibility requirements, and terms, which will be posted or otherwise made available to you. By participating in a Promotion, you agree to be bound by the applicable rules. To the extent the rules of any Promotion conflict with these Terms, the rules of that Promotion will control. Promotions are void where prohibited by law.

11. Disclaimer of Warranties

YOUR USE OF THE SITE IS AT YOUR SOLE RISK. THE SITE AND ALL CONTENT, MATERIALS, INFORMATION, SOFTWARE, AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEXT GENERATION GAMING DOES NOT WARRANT THAT THE SITE, ITS SERVERS, OR EMAIL SENT FROM NEXT GENERATION GAMING ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. NEXT GENERATION GAMING DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE SITE OR ITS CONTENT IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, TIMELINESS, OR OTHERWISE. YOU (AND NOT NEXT GENERATION GAMING) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL NEXT GENERATION GAMING, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT NEXT GENERATION GAMING HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

13. Indemnification

You agree to defend, indemnify, and hold harmless Next Generation Gaming, its affiliates, and their respective officers, directors, employees, agents, contractors, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to reasonable attorneys' fees) arising from: (i) your use of and access to the Site; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; (iv) any Submitted Materials you post to the Site; or (v) any claim that your use of the Site caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the Site.

14. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, all rights granted to you under these Terms will immediately cease. Sections that by their nature should survive termination (including Submitted Materials, Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Indemnification) shall survive.

15. Changes to These Terms

We may revise these Terms from time to time in our sole discretion. When we do, we'll update the "Last updated" date at the top of this page. If a revision is material, we will make reasonable efforts to notify you. Your continued use of the Site after any changes take effect constitutes your acceptance of the revised Terms.

16. Governing Law

These Terms and any dispute arising out of or relating to them or the Site shall be governed by and construed in accordance with the laws of the jurisdiction in which Next Generation Gaming operates, without regard to its conflict-of-law principles. You agree that any legal action or proceeding shall be brought exclusively in the courts of that jurisdiction, and you consent to the personal jurisdiction of such courts.
